Dated updates
This guide launched
We published an independent, plain-English guide to the rule, including the ADU requirements, how to check eligibility, a glossary and an honest list of what's still unknown.
USDA publishes the final rule
The USDA Rural Housing Service published a final rule amending the Single Family Housing Guaranteed Loan Program regulations. It allows financing a single-family home with one or more income-producing ADUs, adds definitions of "Accessory Dwelling Unit" and "Living Unit" to 7 CFR 3555.10, and clarifies that homes with home-based business features stay eligible if they don't need commercial real estate features. Effective date: December 28, 2026.
Public comment period closes
The comment period on the proposed rule closed. The National Association of REALTORS® filed comments supporting the proposal.
USDA proposes the rule
USDA published the proposed rule in the Federal Register as FR Doc. 2026-06173, opening public comment on allowing homes with income-producing ADUs in the Guaranteed Loan Program. The proposal also addressed properties with features for home-based business operations.
How the rule moves from paper to lender
Federal rules follow a set path, and knowing it helps explain why a rule can be "final" while buyers still can't use it yet.
1. Proposed rule
The agency publishes a draft in the Federal Register and invites comments. For the ADU rule, that happened on March 31, 2026.
2. Comment period
Anyone, from homeowners to trade groups, can submit comments. This rule's comment period closed on June 1, 2026.
3. Final rule
After reviewing comments, the agency publishes the finished rule with an effective date. USDA published this one on October 29, 2026, effective December 28, 2026.
4. Program guidance
The regulation in 7 CFR Part 3555 sets the policy. Lenders apply it day to day through USDA's technical handbook, HB-1-3555. Practical details, such as how ADU rental income counts toward qualifying, are expected to come through that guidance. It hasn't been published yet.
5. Lender rollout
Each USDA-approved lender then updates its own systems, training and underwriting. That's why lender availability may come later than the effective date.
